SUCCESSION CERTIFICATE/LETTER OF ADMINISTRATION

It usually takes years for courts to process Letters of Administration (for immovable properties) and Succession Certificates (for movable properties) of any deceased individual. Succession Facilitation Units operated by the National Database Registration Authority facilitate a five-stage process for legal heirs to obtain Letters of Administration or Succession Certificates without having to approach the courts. The only Facilitating Unit in Islamabad handles assets located in the Islamabad Capital Territory (ICT). Several Succession Facilitation Units will be established across Pakistan in the near future by NADRA.

The application form will be available on NADRA’s website and in local newspapers, and applicants will need to submit it. In the event that there are no objections after 14 days (London, Manchester, Birmingham, Bradford, Jeddah, Riyadh, Medina, Dubai, Abu Dhabi, Doha), the legal heirs may conduct the biometric certification at their NADRA office or Pakistan Mission abroad. The applicant will receive a Succession Certificate or Letter of Administration following the biometric verification of the legal heirs. 

The government is also setting up a wide variety of biometric verification centers throughout Pakistan at the earliest possible moment on top of the ones mentioned above. These centers will be set up in a wide range of cities at the earliest possible moment, in addition to those mentioned above.

The following are the steps to apply for a Letter of Administration/Succession Certificate:

1. Application Submission:

Applicants must submit a death certificate, their own national identity number, and their own national identity number. The Applicant must obtain authorization from each legal heir before filing the application on their behalf.

2. Legal Heirs and Assets:

Legal heirs and assets of the deceased must be disclosed by the applicant.

3. Verification of Legal Heirs:

It is the applicant’s responsibility to verify the information provided in the application, as well as the legal heirs named by the applicant, at NADRA’s Registration Center for biometric verification.

4. The Public Notice:

A newspaper notice will be published by NADRA to identify any objections.

5. Letter of Administration/Succession Certificate: 

The applicant will be given the certificate if there are no objections after 14 days.

  • If the asset or property is worth more than Rs. 100,000, a fee of Rs. 20,000 is payable.
  • Assets and properties with an estimated of value less than Rs. 100,000 are subject to a fee of Rs. 10,000.

Duplicate Certificate Fee:

  • It costs Rs. 5000 to obtain a duplicate certificate.

In Pakistan, NADRA Issues Succession Certificates

In succession certificates, assets or properties are transferred from one person to another. This document proves your ownership of a property. Obtaining a mortgage, getting a transfer deed, and accessing credit are all possible with this.

The National Database and Registration Authority (NADRA) is responsible for issuing succession certificates in Pakistan. Asset transfers are documented with the certificate.

It does not require NADRA to change property rights when issuing these certificates, but it does so upon request. Documents are issued only if ownership has changed or if legal ownership has changed, such as a will.

An heir must issue a letter of administration/certificate of succession to claim a deceased person’s property. A Succession Certificate can now be issued by NADRA instead of Civil Courts following the passage of the Letters of Administration and Succession Certificates Act in 2021.

Any existing NADRA office may be designated as a succession facilitation unit, at any location it deems appropriate. Applicants may submit an application in the prescribed manner to NADRA, with the authority of all other legal heirs of the deceased person, based on the jurisdiction in which the deceased ordinarily resided or any assets or properties of the deceased are located, or based on the jurisdiction in which the deceased died. 

A family registration application should be processed as soon as NADRA receives the FRC. 

Documents that should accompany it include:

1) A copy of the deceased’s death certificate

2)  A list containing the names of the legal heirs as well as copies of their CNICs (National Identity Cards)

3)  Approval if all legal heirs request it jointly

4) Letter of Administration/Succession Certificate detailing details of the property which is to be covered by the LOA/SUCcession certificate.

Neither the English-language nor the Urdu-language national newspapers should publish a notice on a web portal.

A verification of biometric data of all legal heirs will take place within fourteen days of publication of the notice if there are no objections. It is issued in favor of all legal heirs along with their respective shares a letter of administration or a certificate of succession.
